Definitions
In these Terms and Conditions (“Terms”):
“Customer” refers to the individual, institution, or entity purchasing goods or services from French Librairie.
“Goods” means the books, materials, or any other items supplied by French Librairie.
“French Librairie” or “we/us” means French Librairie, the seller and operator of the website.
“Intellectual Property Rights” includes all patents, registered and unregistered designs, copyright, trademarks, know-how, and all other intellectual property rights enforceable worldwide.
These Terms apply to all orders placed via our website, WhatsApp catalogue, email, or any other official sales channel.
Website Content
All Goods displayed on the French Librairie website or digital catalogue are presented with images, descriptions, pricing, and availability. While we make every effort to ensure accuracy, minor discrepancies may occur due to screen variations, supplier updates, or typographical errors.
French Librairie reserves the right to correct any errors, inaccuracies, or omissions at any time without prior notice.
Princes & Payment
Prices shall be as published on the French Librairie website or as quoted in official correspondence at the time of placing an order. Prices are valid only at the time of quotation or listing and may be adjusted without prior notice.
All prices are listed in Kenya Shillings (KES) and are inclusive of VAT or applicable government taxes unless stated otherwise.
Payment is due in full at the time of placing the order. We do not offer cash on delivery. Orders are only processed once payment is confirmed.
Accepted payment methods include:
- M-PESA
- Cheque (schools and institutions only, subject to prior written agreement)
French Librairie reserves the right to reject any order at its sole discretion, without liability.
Stock and Availability
All orders are subject to stock availability. Where items are out of stock, customers may select alternative Goods, request notification when stock is replenished, or opt for a refund.
French Librairie shall not be liable for delays, losses, or damages arising from stock-outs.
Risk & Title
Risk in the Goods passes to the Customer upon delivery to the address provided or upon collection from a designated pick-up point, even if the Customer does not expressly accept the delivery.
Title in the Goods shall not pass to the Customer until full payment has been received by French Librairie. Until such payment is made, the Customer holds the Goods solely as bailee for French Librairie.
Delivery
Delivery charges, timelines, and methods are determined at checkout and may vary by location, courier, or order weight.
Standard delivery timelines within Kenya are 2–5 working days after payment confirmation, subject to courier availability and external conditions. International orders are subject to additional customs duties, taxes, and courier regulations, which shall be borne by the Customer.
French Librairie is not responsible for delays arising from inaccurate delivery details, courier delays, customs clearance, natural disasters, or force majeure events.
Returns and Refunds
Returns must be initiated within 7 days of receipt of Goods. Returned Goods must be unused, in original packaging, and accompanied by proof of purchase.
Certain items are strictly non-returnable, including but not limited to:
- Novels and fiction books
- Children’s and adults’ storybooks
- Revision books
- All digital products, such as e-books or downloadable resources.
- Stationery items
Refunds are processed only after inspection and approval of returned Goods. Transaction charges (including M-PESA or bank fees) and delivery fees are non-refundable unless the error was on the part of French Librairie.
Partial refunds may apply in cases where Goods are returned in unsellable condition, damaged by the Customer, or returned after the 7-day period.
Customer Obligations
The Customer agrees to:
- Provide accurate and complete order and delivery details;
- Respond promptly to communications relating to orders;
- Collect Goods from courier offices where door-to-door delivery is not available;
- Bear responsibility for any costs arising from failure to provide accurate delivery
information.
Limitation of Liability
French Librairie shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of business, profits, or goodwill.
Our liability for any breach of contract, misrepresentation, or negligence shall not exceed the total purchase price paid by the Customer for the Goods in question.
Intellectual Property Rights
All intellectual property displayed on the website, including logos, images, text, and designs, remains the property of French Librairie and may not be reproduced or used without prior written permission.
Promotions and Discounts
From time to time, French Librairie may offer promotions or discounts. These offers are valid only during the stated promotional period and are subject to specific terms and conditions.
Discounts cannot be combined with other offers unless explicitly stated.
Force Majeure
French Librairie shall not be held liable for delays or failure to fulfill obligations under these Terms if such delays or failure result from causes beyond our reasonable control, including but not limited to natural disasters, strikes, courier disruptions, government restrictions, internet outages, or other unforeseen events.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts.
Amendments
French Librairie reserves the right to amend, update, or revise these Terms at any time. Any changes shall become effective immediately upon posting on the website. Continued use of the website or purchase of Goods constitutes acceptance of the revised Terms.
General
- Nothing in these Terms shall be construed as establishing or implying any partnership, agency, or joint venture between the Customer and French Librairie. Each party remains independent, and no party shall be deemed the agent of the other.
- Unless expressly agreed otherwise in writing, these Terms shall apply to all agreements between French Librairie and the Customer, to the exclusion of any standard terms and conditions proposed by the Customer or implied by law, trade custom, practice, or course of dealing.
- Acceptance of Goods by the Customer shall be deemed to constitute full and unconditional acceptance of these Terms.
- Any variation to these Terms (including special arrangements agreed with schools, institutions, or bulk buyers) shall only be valid if agreed in writing and confirmed by French Librairie.
- French Librairie reserves the right to amend these Terms at any time by written notice or by publishing updated Terms on its website.
- If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
- The Customer may not assign or transfer their obligations under any agreement with French Librairie without prior written consent.
- French Librairie may assign or transfer its rights or obligations at its sole discretion by issuing notice to the Customer.
- Failure by either party to enforce any provision of these Terms at any time shall not be construed as a waiver of that provision or of the right to enforce it at a later time.
- Both parties shall comply with all applicable data protection and privacy laws, including the Data Protection Act, 2019 (Kenya), and French Librairie’s Privacy Policy, with respect to the handling of personal data.
